KUALA LUMPUR: Datuk Seri Najib Razak is suing Petaling Jaya Utara MP Tony Pua Kiam Wee for defamation over a live video posted on the latter's Facebook page on the tabling of the Shariah Courts (Criminal Jurisdiction) Act 1965 (Act 355), also known as RUU355.

The Prime Minister filed the legal action in his personal capacity through Messrs Hafarizam Wan & Aisha Mubarak at the High Court registry here today, naming Pua as the defendant.

In his statement of claim, Najib claims that on April 6, Pua made a statement at the Parliament building area, which was recorded.

He claims that the 2-minute-21-second recording containing the statement was uploaded, on the same day, on Pua's Facebook page 'Tony Pua', entitled "BN abandons all Bills to give precedence to PAS RUU355 Private Member's Bill".

Najib claims that the statement in the live video was specifically directed at him and that there was malice in the defendant's (Pua) libellous statement, and that it was made with bad intention to defame him (Najib).

Najib also claims that the defendant had slandered him under Section 5 of the Defamation Act 1957 against the position held by the plaintiff (Najib).

He is seeking for general, aggravated and exemplary damages, as well as an injunction to prevent the defendant – either by himself or any of his agents, in whatever way – from publishing further statements that are defamatory in nature.

Najib is also seeking for the defendant to publish an unequivocal written apology in at least two newspapers.

Among others, the plaintiff is also seeking for the defendant to remove the live video from his Facebook page immediately.
