MELAKA: A ‘kuaci’ seller at a nightclub was slapped with a RM1,200 fine and a day’s jail for stealing items, including condoms, from a mall here.
Too Loi Heng, 34, from Jalan Taming Sari, pleaded guilty to the charge when it was read to him before magistrate Mohd Firdaus Saleh.
According to the charge under Section 380 of the Penal Code, Too was accused of stealing three packets of Nestle KitKat, four boxes of Durex Love, three boxes of Durex Close Fit, six cans of Guinness beer, and a 2kg packet of Milo, all worth RM173.71, from Aeon Bandaraya Melaka about 4pm on Feb 13 last year.
The offence of committing theft in a building provides a maximum jail sentence of 10 years and is liable to a fine.
According to the facts of the case, a security guard at the mall, Mohd Khari Ali, spotted Too behaving suspiciously.
He saw Too inserting goods into two bags, but while at the cashier, the accused only paid for half the items he took.
The security guard then followed the suspect to the Zon B exit and stopped him before arresting him for a security check.
An auxiliary policeman found unpaid items worth RM173.71 on Too.
The security guard lodged a report on Feb 13 last year.
Deputy public prosecutor N. Sivashangari urged for the court to impose a deterrent sentence as the stolen goods were not essential items.
Too, who was unrepresented, pleaded for a lenient sentence, saying he had to take care of his wife and two children, aged 5 and 11.
Firdaus handed down a sentence of a day’s jail and a RM1,200 fine in default of a month’s jail.
